Fayetteville Town Council 10/1 Recap

The Fayetteville Town Council met for their regularly scheduled meeting on Thursday, Oct. 1, 2026 at 6:00 PM. 

All stood as the meeting opened with prayer by Mayor Sharon Cruikshank, followed by the Pledge of Allegiance. All council members were present except for Councilor Brian Good.  The audience seating was partially full, with approximately 10-12 guests present. 

The following is a summary of highlights and does not cover everything on the agenda.  You can find the meeting minutes on the Town Council website. 

 


October Happenings

General comments were made by Mayor Cruikshank regarding several upcoming events in October such as the ribbon cutting ceremony for Hill Hall Hotel on Oct. 6 at 3:30 PM.  She said there will be a shuttle running from the new parking lot up to the hotel. 

She also reminded everyone about the Oct. 9 ribbon cutting at 10 AM for the new Fayetteville Marketplace (in the former Ben Franklin's building) and said what a great asset this is going to be for the town.

October 9th is also the day an old friend of Fayetteville will be in town, Charlie McCoy. A WV born harmonicist and multi-instrumentalist, Fayetteville's Town Park is named in honor of this generous award winning musician.

During the 80's, when the park was being developed, McCoy recruited fellow country music legends such as Barbara Mandrell and Tom T. Hall to perform at the Memorial Building to raise funds for the park.  He will be in town for the Heritage Walk with Charlie McCoy, starting at 4:30 PM on Oct. 9th at the Memorial Building Lawn. Refreshments will be served at the new Welcome Center. 

Town Recorder, Zenda Vance, said the Trunk or Treat will be happening again on Court St. from 5:30 PM- 7:30 PM on Halloween, Oct. 31.  General trick-or-treat for the town will be from 6:00-8:00 PM.

Councilor Stanley Boyd commented on the historic High School trophies being on display at the new Hill Hall Hotel. He said some awards are also being displayed at the new Welcome Center to honor Fayetteville's alumni. 


Fayetteville Police Dept.

Promotions in the Fayetteville Police Department were recognized and sworn in for JH Rice, from Corporal to Sergeant and JP Hannigan, from PFC to Corporal.

Councilor Stanley Boyd commented about Bridge Day and the need for the community to help with trash cleanup afterwards. He said the Lions Club will be out on Saturday after the event and they always need volunteers to help. 

Police Chief Hogan said the signage and location of patrols would be changed this year during Bridge Day to prevent event traffic from congesting residential streets.

Councilor Gabe Peña said the Water Quality Board met last Tuesday. He stated that E.L. Robinson had to push back the House Branch project but hopes to have it completed by the end of the year.  He said there will be a public hearing on storm water management plan on Monday, Nov. 9 at 5:00 PM.  He indicated that this is regarding quality and maintenance issues. 

Several council members made heartfelt comments about the passing of community leader, John Tuggle, and how much the town and surrounding areas had benefitted from his tireless work. He served as executive director of the Region 4 Planning and Development Council and worked on economic development including many infrastructure projects and helped to secure funding for many communities.
 

Town Manager, Matt Diederich said multiple letters have been sent to the post office regarding repairs needed on the steps and the necessity for wheelchair accessibility.  He said the county has also been contacted as well as U.S. Senator Shelley Capito's office. 



Visitor Comments

Sarah Howe spoke about the town ordinance, section 505.12 titled "Keeping Noisy Dog or Cat".  She said she didn't realize the ordinance had been changed.

She said that on her street, there are twelve dogs, but the cops are only called to her house regarding her barking dogs. Howe said her dogs are not aggressive. She feels like the police are being taken away from more important work by being called to her house to address the barking. She said only one bark could elicit a visit from the police to her home. 

She expressed frustration that one person can make a complaint that would cause a town ordinance to be changed and says she feels harassed at this point. She asked for the town ordinance to revert back to its original form. 

 
Craig Reger also spoke about the same ordinance saying he also didn't know it had changed. He was given a copy of the new ordinance as he arrived at the meeting this evening. 

He said he has attended many town council meetings over the last four years regarding this issue and has provided proof regarding the noise of the barking dogs that wake him up as early as 5:30 AM. Reger said he has taken the issue to court and followed the recommended path to have the issue resolved, but the county dismissed the case due to it being a town issue.  He says the ordinance is not effective because when cops are called there is no clarity on what they can do to resolve the problem.  

He says his business gets attacked when he makes a complaint against the barking dogs, in the form of negative reviews online. He said this was defamatory and a slander to his character and business and causes stress. He asked for more clarity regarding the penalties for the new ordinance.


The new ordinance both visitors spoke about was with regard to an amendment of 505.12 "Keeping Noisy Dog or Cat" that was passed by the Town Council on May 21, 2026: 



 

Town Attorney, Carl Harris said toward the end of the meeting that there are codified penalties for breaking this ordinance, including fines up to $500.




Wolf Creek Dam, Sidewalks and The Outpost

 

There was continued discussion regarding the proposed actions on the Wolf Creek Dam. Town Manager, Matt Diederich said it would take two years for the design phase and no money from the town was needed for this phase. Councilors leaned toward the option of partial dam removal and agreed to proceed with the two year design phase; they were in agreement not to use town funds for this project. 

The needed sidewalk repairs on sections of Maple Ave., Fayette Ave., Wiseman Ave., Court St. and Lively St. were discussed.  Town Manager, Matt Diederich said East Maple has some of the worst spots in need of attention.  He said he had spoken with the Board of Education and they will be addressing sidewalks they are responsible for.  Diederich said we need to get this project moving forward by prioritizing need, receiving feedback, planning phases and said there are also easements to consider.  

Councilor Gabe Peña said the sidewalk work would not be done by the end of this year and recommended to use the winter months to prioritize the sections needing repair and collect bids.  Discussion among council members included researching linear fee estimates and making sure sidewalks are handicapped-accessible. 

The Outpost, located on Fayette Station Rd., within city limits, has requested zoning reclassification to General Commercial.  There will be a public hearing regarding this item on Nov. 19 at 5:30 PM. 

The next Town Council meeting is scheduled for Thursday, Oct. 15 at 6:00 PM
